Interim Administrative Measures for Imported and Exported Crop Seeds (Seedlings)

Chapter I General Provision
　
Article 1 These Measures are formulated in order to further implement relevant laws and regulations on administration of seeds, strengthen the administration on germplasm resources, and promote the foreign trading, cooperation and exchange of Chinese crop seeds (seedlings).
　
Article 2 The imported and exported crop seeds (seedlings) under these Measures (hereinafter referred to as the "Crop Seeds") include the germplasm resources imported from or exported to foreign countries (regions) for the purpose of research (hereinafter referred to as the "Imported and Exported Germplasm Resources") and the seeds imported or exported for production.
The seeds imported and exported for production include seeds for experiments, qualified commercial seeds and seeds for external seed production.
　
Article 3 The entities engaging in import and export of seeds for production and providing germplasm resources for foreign countries (regions) shall have the qualification of Chinese legal person. Individuals are prohibited from engaging in import and export of seeds for production and from providing germplasm resources for foreign countries (regions).
The entities engaging in import and export of qualified commercial seeds shall have the right to produce and operate seeds and the right to export and import seeds which are compatible with the types of seeds to be imported and exported by such entities. In the event that any such entity has no such rights, it shall entrust the entity with the right of import and export designated by the Ministry of Agriculture to do so.

Chapter II Administration on the Import and Export of Germplasm Resources
　
Article 4 The germplasm resources to be provided to foreign countries (regions) shall be subject to administration of classified catalogue of crop germplasm resources. The germplasm resources belonging to the resources that may be subject to "conditional foreign exchange" or "qualified for foreign exchange" shall be reviewed and verified by the provincial-level crop administration authority and shall be submitted to the Institute of Crop Germplasm Resources of Chinese Academy of Crop Sciences (hereinafter referred to as the "ICGR") which shall go through the examination and approval formalities after obtaining the approval of the Ministry of Agriculture (hereinafter referred to as the "MOA"); the germplasm resources that "cannot be exported for foreign exchange" and are not subject to the national uniform numbering shall not be provided to foreign countries (regions); if such resources is required to be provided to foreign countries (regions) under special circumstances, such provision shall be subject to the review and verification of the ICGR and the approval of the MOA.
