The Regulations on Agricultural Insurance, which were adopted at the 222nd executive meeting of the State Council on October 24, 2012, are hereby promulgated and shall come into effect as of March 1, 2013.

Regulations on Agricultural Insurance

Chapter I General Provisions

Article 1 These Regulations are formulated pursuant to the Insurance Law of the People's Republic of China, the Agricultural Law of the People's Republic of China and relevant laws for the purpose of regulating agricultural insurance activities, protecting lawful rights and interests of all parties to agricultural insurance activities, improving anti-risk capability of agricultural production and promoting healthy development of the agricultural insurance business..

Article 2 For the purposes of these Regulations, the term "Agricultural Insurance" means the insurance activities whereby insurance institutions assume responsibilities of insurance payment, in accordance with agricultural insurance contracts, for the insured's property loss in production of crop farming, forestry, stock raising and fishery as a result of the insurance objects' suffering from such contractual insured events as natural disasters, accidents, plagues and diseases, etc.
For the purposes of these Regulations, the term "Insurance Institutions" refers to insurance companies and legally established agricultural mutual insurance and other insurance organizations.

Article 3 The State supports development of varying kinds of agricultural insurance and improves the policy-oriented agricultural insurance system.
Agricultural insurance shall be conducted under the principle of guidance by government, market-oriented operation, independence and voluntariness and synergetic promotion.
People's governments of provinces, autonomous regions and municipalities directly under the Central Government may determine agricultural insurance operating modes applicable to local circumstances.
No entity or individual may force or restrict farmers or agricultural production and operation organizations to participate in or from participating in agricultural insurance by advantage of administrative powers, positions or occupations or in other forms.

Article 4 The insurance regulatory authority under the State Council shall be responsible for supervision and administration of agricultural insurance businesses. Authorities under the State Council as finance, agriculture, forestry, development and reform, taxation and civil affairs, etc. shall be responsible for affairs in connection with promotion and administration of agricultural insurance based on their respective duties.
Authorities and institutions of finance, insurance supervision and administration, land and resources, agriculture, forestry and meteorology, etc. shall establish mechanisms for sharing information related to agricultural insurance.

Article 5 Local people's governments above the county level shall uniformly guide, organize and coordinate local agricultural insurance affairs, and establish and improve working mechanisms for promoting development of agricultural insurance. Competent departments of local people's governments above the county level shall be responsible for affairs in connection with promotion and administration of local agricultural insurance based on the duties assigned by the people's government at the same level.

Article 6 Relevant departments and institutions under the State Council and local people's governments at each level and their departments concerned shall adopt varying forms to strengthen publicity of agricultural insurance, increase insurance awareness of farmers and agricultural production and operation organizations, organize and guide farmers and agricultural production and operation organizations to positively participate in agricultural insurance.

Article 7 If the insured agricultural insurance object of any farmer or agricultural production and operation organization falls within the scope of premium subsidy granted by the finance authority under the State Council, the finance authority shall extend premium subsidy pursuant to provisions.
