Decision of the Standing Committee of National People's Congress on Revision of the Law of the People's Republic of China on the Promotion of Agricultural Technology, adopted by the 28th meeting of the Standing Committee of the Eleventh National People's Congress on August 31, 2012, is hereby promulgated and shall come into force as of January 1, 2013.

Decision of the Standing Committee of National People's Congress on Revision of the Law of the People's Republic of China on the Promotion of Agricultural Technology

The 28th meeting of the Standing Committee of the Eleventh National People's Congress has decided to revise the Law of the People's Republic of China on Promotion of Agricultural Technology as follows:
I. "Safeguarding the development of agriculture" in Article 1 shall be revised to read "strengthening the supporting and safeguarding capacity of science and technology, promoting the sustainable development of agriculture and rural economy".
II. Paragraph 1 of Article 2 shall be revised to read: "Agricultural technologies mentioned in this Law shall refer to scientific achievements and practical technologies applied in the industry of farm production, forestry, animal husbandry and fishery, including:
"1. technologies of stock breeding, cultivation, fertilizer application and aquaculture;
"2. technologies on prevention of plant diseases and insect pests, animal epidemic diseases and other pests;
"3. technologies on harvest, process, packaging, storage and transportation of agricultural products;
"4. technologies on safe utilization of agricultural input and quality safety of agricultural products;
"5. technologies on irrigation and water conservancy, rural water supply and drainage, soil improvement and soil and water conservation;
"6. technologies on agricultural mechanization, farm-oriented aviation, agricultural meteorology and agricultural information;
"7. technologies on agricultural disaster prevention and reduction, safety of agricultural resources and agro-ecology, and exploitation and utilization of rural resources;
"8. other agricultural technologies."
"Overall process before, in and after the agricultural production" in Paragraph 2 shall be revised as "Overall process before, in and after the agriculture."
III. Article 3 shall be revised to read: "The state shall support the cause of promoting agricultural technologies, accelerate the promotion and utilization of agricultural technologies, and develop ecological and safe agriculture characterized with high yielding, high quality and efficiency."
IV. Item 1 of Article 4 shall be revised to read: "benefiting the sustainable development of agriculture and rural economy and increasing farmers' incomes."
Item 2 thereof shall be revised as: "respecting the intentions of agricultural workers and agricultural production and operation organization".
Item 4 thereof and Item 5 shall be combined as Item 4, and revised as: "the categorized management shall be implemented on promotion for public welfare and operation".
Item 6 thereof shall be revised as Item 5, and revised as: "giving consideration on economic benefit and social benefit, focusing on ecological benefit".
V. A paragraph shall be added to Article 5 as Paragraph 2 that reads: "The state encourages to apply the modern information technology and other advanced communication methods, to promote the agricultural scientific knowledge and to innovate the methods and means of promotion of agricultural technologies so as to enhance the efficiency of promotion."
VI. "Enhancing the service level of promoting agricultural technologies" shall be inserted after "organizing the relevant departments and units to take measures" in Article 7.
VII. Article 9 shall be revised to read: "The departments of agriculture, forestry and water conservation, etc. of the State Council (hereinafter collectively referred to as the Departments Promoting the Agricultural Technologies) shall, according to the respective duties, be responsible for relevant works of promoting the agricultural technologies within national-wide scope. The departments promoting the agricultural technologies of the local people's governments above the county level shall, under the leadership of the people's government at the same level, according to the respective duties, be responsible for relevant works of promoting the agricultural technologies within the administrative regions.
