Administrative Measures for Green Food Labels, which were deliberated and adopted at the 7th executive meeting of the Ministry of Agriculture on June 13, 2012, are hereby promulgated and shall come into effect as of October 1, 2012.

Administrative Measures for Green Food Labels
Chapter I General Provisions
Article 1 These Measures are hereby enacted pursuant to the Agricultural Law of the People's Republic of China, Food Safety Law of the People's Republic of China, Law of the People's Republic of China on Agricultural Product Quality and Safety, and Trademark Law of the People's Republic of China for the purposes of intensifying the administration of the use of green food labels, ensuring the fame of green food, promoting the healthy development of green food industry and maintaining the lawful rights and interest of the production operators and consumers.
Article 2 In these Measures, "green food" refers to the safe and high quality eatable agricultural products and relevant products which are produced according to green food standards through whole-process quality control in excellent ecological environment and have obtained the rights for using green food labels.
Article 3 Green food labels which have been registered as certification trademarks shall be protected by the laws.
Article 4 The administrative department of agriculture of the people's government at the county level or above shall take charge of the supervision and administration of green food and green food labels according to the law.
Article 5 Green Food Development Center shall be responsible for the examination, issuance of certificates and the follow-up inspection thereafter of the application for using green food labels across the country.
The green food working organ under the administrative department of agriculture of the people's government at the provincial level (hereafter referred to as the "provincial working organ") shall be responsible for the acceptance, preliminary examination and the follow-up inspection thereafter of the application for using green food labels within the administrative district.
Article 6 The standards and rules for the environment of the place of origin, production technology, product quality and packaging, storage and transportation of green food shall be enacted and released by the Ministry of Agriculture.
Article 7 The technological organ undertaking the inspection of the green food products and the environment of place of origin thereof shall be equipped with the corresponding inspection conditions and capability, pass the qualification accreditation according to the law, be selected by Green Food Development Center according to the principle of fairness, impartiality and competitiveness, and shall be submitted to the Ministry of Agriculture for archival-filing.
Article 8 The administrative department of agriculture of the people's government at the county level or above shall encourage and support the production of green food, incorporate the production of green food into the local agricultural and rural economic development planning, and support the building of green food production bases.
Chapter II Application and Verification for the Use of Labels
Article 9 Products under the application for using green food labels shall conform to the Food Safety Law of the People's Republic of China, the Law of the People's Republic of China on Agricultural Product Quality and Safety, and other laws and regulations and shall satisfy the following conditions within the scope as verified by the Trademark Office of the State Administration for Industry & Commerce,
