Lead-acid Batteries Industry Access Standards

Announcement of the Ministry of Industry and Information Technology and the Ministry of Environmental Protection [2012] No.18

For the purposes of facilitating the structural adjustment and industry upgrade of the lead-acid batteries industry of China, regulating the industry investment activities, preventing low-level repeated construction, protecting ecological environment and enhancing the comprehensive resource utilization efficiency, and pursuant to relevant laws, regulations and industry policies of the State, the Ministry of Industry and Information Technology and the Ministry of Environmental Protection have jointly enacted the Lead-acid Batteries Industry Access Standards, which is hereby announced as follows.

When conducting such work as investment management, land supply, environmental protection examination, credit and financing, electricity supply and safety license in connection with the lead-acid batteries, relevant departments shall rely on these Access Standards.

For the purposes of facilitating the sustainable, healthy and coordinated development of the production industry of lead-acid batteries and their lead-bearing spare parts in China and regulating the industry investment activities, and pursuant to the Environmental Protection Law of the People's Republic of China, the "12th Five-Year" Plan for the Comprehensive Control and Prevention of Heavy Metals Pollution and the Guiding Catalogue for Industrial Structure Adjustments (Version 2011) and other relevant laws, regulations and industry policies of the State, and in accordance with the principles of reasonable layout, aggregate control, stock optimization, environmental protection and orderly development, the lead-acid batteries access standards are therefore enacted.

I. Enterprise Layout
1. Newly built projects shall be constructed within the corresponding functional zone in the industry park at the county level or above as legally approved to be established and in compliance with the requirements in the Standards for Hygienic Buffer Zone of Lead-acid Batteries Plant (GB11659). Regions with applicable conditions shall gradually move the production enterprises into the industry park. All production projects of lead-acid batteries and lead-bearing spare parts are prohibited to be newly built within the key area of the control and prevention of heavy metals pollution. All new or reconstruction and expansion projects must have sources for total amount of discharge of heavy metals pollutants as determined by the local competent environmental protection department at the provincial level or above.
2. No new or reconstruction and expansion projects in connection with the production of the lead-acid batteries and their lead-bearing spare parts may be conducted within the such environmental sensitive areas of all types and at all levels as natural reserves and cultural protected areas as provided in Article 3 of the Catalogue for Construction Project Environmental Impact Assessment Classification Management (Order No.2 of the Ministry of Environment) and within the scope of protection of arable land and basic farmland as determined in the overall planning of land utilization.

II. Production Capacity
1. For newly built or reconstructed and expanded lead-acid batteries production enterprises (projects), the annual production capacity of the same plant area after the completion of construction shall not be lower than 500,000KVA (as per 8 hours for one shift, same as below).
2. The annual production capacity of the same plant area of current lead-acid batteries production enterprises shall not be lower than 200,000 KVA; and for current commodity electrode plate (which refers to the electrode plate for lead-acid batteries that is sold by means of battery accessories) production enterprise (projects), the electrode plate production capacity of the same plant area shall not be lower than 1 million KVA.
3. For spiral-wound lead-acid batteries, bipolar lead-acid batteries, lead-carbon batteries (super batteries) and other new-type lead-acid batteries, or production projects that adopt the extended (casting, punching, roll and punch, etc.) grid manufacturing process, the production capacity shall not be subject to any limitation.

III. Construction Projects Not Meeting Access Conditions
1. Production projects for common open lead-acid batteries (which refer to lead-acid battery adopting the unfiltered acid mist of direct structure and with consistent pressure inside and outside the battery).
