The Regulations of the Jiangsu Province on Informatization, which were adopted at the 24th Session of the Standing Committee of the Eleventh People's Congress of Jiangsu Province on September 23, 2011, is hereby promulgated, and shall come into force as of January 1, 2012.

Chapter I General Provisions
Article 1 In order to protect the development of informatization, improve the level of informatization, standardize the informatization management, and promote economic development and social progress, in accordance with the provisions of relevant laws and administrative regulations, combined with the realities of this province, these Regulations are hereby formulated.
Article 2 The informatization planning and construction, information resource sharing and development and utilization, information industry development and technology promotion and application, information security protection and related management activities within the administrative divisions of this province, shall apply to these Regulations.
Article 3 Informatization development shall follow the principles of overall planning, resource sharing, unified standards, practicality and efficiency, benefiting people in priority, and ensuring security.
The public shall equally enjoy the right to access to and use the public information resources.
Article 4 The local people's governments at or above the county level shall include the informatization development into the national economic and social development planning, establish and improve the informatization leadership and coordination mechanisms, and implement the government information management system.
The local people's governments at or above the county level shall formulate relevant supporting policies, arrange special funds for informatization, support and promote the informatization development, give priority to support the implementation of the construction of the basic public information system for resource sharing, business collaboration and information security.
Encourage citizens, legal persons and other organizations to invest in the informatization construction according to the laws.
Article 5 The competent informatization authorities of the local people's governments at or above the county level are responsible for the overall planning and co-ordination, planning and designing organization and promotion, supervision and management of the informatization development within their administrative divisions.
The departments of development and reform, finance, public security, radio and television, as well as the communication management agencies of local people's governments at or above the county level are responsible for the management of informatization development within the scope of their duties.
Article 6 The competent informatization authorities of the local people's governments at or above the county level shall, jointly with the statistics and other related departments, establish the evaluation system for informatization development level of their regions, and regularly publish the evaluation reports.
When establishing the evaluation system for informatization department level of their regions, the competent informatization authorities of the people's governments of the cities and counties (cities, districts) divided into districts shall base on the evaluation system for informatization development level of the province.
Article 7 The purchase of goods, projects and services for informatization development with the financial funds shall conduct the government procurement in accordance with the laws.
Article 8 Encourage and support the research and innovation of informatization, training and introduction of information technology talents, and strengthen the popularity of a variety of informatization knowledge and skills.
Popularize information technology education in primary and secondary schools, encourage to develop the vocational education of information technology. Radio, television, newspapers, Internet and others shall carry out the publicity, education and scientific popularity activities for informatization.
Article 9 The local people's governments at or above the county level shall praise the units and individuals that made outstanding contributions in the development of informatization.
Chapter II Informatization Planning and Construction
Article 10 The competent information authorities of the local people's governments at or above the county level shall, jointly with relevant departments, according to the provisions of the laws and regulations, and the information development planning of the superiors, as well as national economic and social development planning at their levels, organize to prepare the information development planning of their administrative areas, implement after reported and approved by the people's governments at the same level, and also report to the competent information authorities at next higher level for record.
Other relevant departments of the local people's governments at or above the county level shall, in accordance with the information development planning system of their administrative areas, prepare the information development planning for their systems and departments, and report to the competent information authorities of the people's governments at the same level for record.
The preparation, approval, implementation and supervision of information development planning shall follow the statutory conditions and procedures.
Article 11 The competent informatization authorities of the local people's governments at or above the county level shall, jointly with relevant departments, according to the urban and rural planning and informatization development planning at their levels, prepare informatization infrastructure construction planning of their administrative areas, and link to the development planning of the superior communications industry, radio and television industry and the disaster prevention and reduction and national defense.
The new construction, renovation and expansion of the telecommunications networks, radio and television networks and Internet and other information infrastructures, shall comply with the requirements of the information infrastructure planning of the administrative areas, implement intensive construction and management, improve the utilization rate of infrastructure, and avoid repeated construction.
Article 12 The telecommunications networks, radio and television networks, Internet and other information pipelines and wiring facilities within the commercial development buildings, as well as the information pipelines within the range of the land for construction projects, shall be included into the design documents of the construction projects and constructed at the same time with the construction projects by the construction units, and the cost shall be borne by the construction units.
The new construction, renovation or expansion of customer premises networks for constructed buildings shall respect the owners' choices, open to all telecommunications, radio and television service operators and other CPN-builders, and implement equal access and fair competition.
Article 13 No units or individuals may damage or dismantle without authorization, and migrate the telecommunications networks, radio and television networks and Internet and other information infrastructures.
