Regulations of Shaanxi Province on the Protection of Emperor Qins Mausoleum

Announcement of the Standing Committee of the People's Congress of Shaanxi Province No. 40

The Regulations of Shaanxi Province on the Protection of Emperor Qins Mausoleum have been adopted at the 20th Session of the Standing Committee of the 10th People's Congress of Shaanxi Province on July 30, 2005, are hereby promulgated and come into force on October 1, 2005.
 
Article 1 These Regulations are formulated for the purpose of strengthening the protection of Emperor Qin's mausoleum and preserving the authenticity, the integrity, and the harmonization of the historical style and features of Emperor Qin's mausoleumin and the natural environment, in accordance with the Law of the People's Republic of China on the Protection of Cultural Relics and the related laws and administrative regulations, and in combination of the reality of the protection work of Emperor Qin's mausoleum.
 
Article 2 Organizations and individuals that carry out activities such as the protection of cultural relics, production and living, management and services, tourism development, visiting and sightseeing and so on within Emperor Qin's mausoleum shall comply with these Regulations.
 
Article 3 The protection of Emperor Qins mausoleum shall persist in the guidelines of protection in priority, salvage at first, utilization with reason, management with reinforcement, and handle correctly the relations between the culture relics protection and the local social and economic development and the production and living of the people.
 
Article 4 Emperor Qins mausoleum is the key protection unit of the world cultural heritage and the cultural relics. The cultural relics of Emperor Qins mausoleum shall belong to the possession of the State, no units or individuals shall be allowed to excavate or to possess illegally, the transferring and mortgaging shall be prohibited, and shall not be used for the management as enterprise assets.
Every unit and individual shall have the obligation to protect the cultural relics of Emperor Qins mausoleum, and the right to prevent and to report those behaviors that damage or destroy the cultural relics of Emperor Qins mausoleum and the historical style and features and the natural environment. All the units and individuals shall be encouraged to contribute to the State their legally collected cultural relics related to Emperor Qins mausoleum.
 
Article 5 The following cultural relics of Emperor Qins mausoleum shall be protected as the protection objects according to law:
(1) The architecture sites including grave mound. and underground palace, the inner city wall and the outer city wall, coffin chambers site, subordinate palace site, homes of officials in charge of gardens and temples and three cloisters site;
(2) The funerary pits including terracotta warriors and horses pit , stone loricae pit , horse and chariot pit, stables pit, pottery figurine of actors pit, rare birds and beasts pit and imperial storage pit;
(3) Accompanying tombs and mausoleum builder cemetery;
(4) The ancillary facilities of the mausoleum including flood-controlling mound, fish pond site, stone processing field and Liyi town site; and
(5) The cultural relics and others with historical, artistic and scientific values embedded at the sites.
