Regulations of Anhui Province on the Transformation of Scientific and Technological Achievements

The Regulations of Anhui Province on the Transformation of Scientific and Technological Achievements have been adopted at the Fifth Session of the Standing Committee of the Tenth People's Congress of Anhui Province on Oct. 24th 2003, and was effective as of Jan. 1st, 2004.

Chapter I General Provisions
　
Article 1 The Regulations herein are formulated according to the Law of the People's Republic of China on Promoting the Transformation of Scientific and Technological Achievements as well as other relevant laws and administrative regulations in light of the actual circumstances of the Province with the purpose of promoting the transformation of scientific and technological achievements.
　
Article 2 The Regulations shall apply to the execution of the transformation of scientific and technological achievements within the administrative region of the Province.
　
Article 3 The "Transformation of Scientific and Technological Achievements" referred to in the Regulations means the follow-up experiment, development, application and promotion of any scientific and technological achievement of practical values that is made through scientific researches and technological development and is aimed at improving the productivity, including any activity that formulates a new product, a new technology, a new process, a new material, and the development of a new industry.
　
Article 4 The execution of the transformation of scientific and technological achievements shall be conducive to the improvement of economic and social benefits, to environment and resources protection, and to sustainable developments.
　
Article 5 The execution of the transformation of scientific and technological achievements shall protect the interests of the state and the public interests of the society, and shall follow the principle of voluntariness, mutual benefits, fairness, faithfulness and creditability.
The intellectual property rights and other relevant legal rights and interests arising out of the transformation of scientific and technological achievements are protected by laws.
　
Article 6 The people's governments at all levels shall be responsible to administer, instruct and coordinate the promotion of the transformation of scientific and technological achievements within the competent administrative region, and include the transformation of scientific and technological achievements into the national economic and social development plan.
The administrative departments for science and technology and other relevant departments of the people's governments above the county level shall be responsible for the promotion of specific tasks in the transformation of scientific and technological achievements within their respective range of responsibility.

Chapter II Promotion Measures
　
Article 7 In order for the promotion of the transformation of scientific and technological achievements, a system shall be set up, in which supports from the government shall be integrated with market orientation, charged services shall be integrated with free-of-charge services, and national institutions for the promotion of the transformation of scientific and technological achievements shall be integrated with the forces from the society, so as to launch the scientific and technological achievements into production as soon as possible.
　
Article 8 The People's Government of the Province shall, in view of the requirements for economic and social development, release regularly lists of scientific and technological achievements and manuals of key projects of the transformation of scientific and technological achievements, and give preference to the execution of the following projects of the transformation of scientific and technological achievements;
1. Projects that will improve greatly the technological level of the industry as well as the economic and social benefits;
