Decision of the National People's Congress on Amending the Electoral Law of the People's Republic of China on the National People's Congress and Local People's Congresses

The Decision of the National People's Congress on Amending the Electoral Law of the People's Republic of China on the National People's Congress and Local People's Congresses,adopted at the third session of the 11th National People's Congress of the People's Republic of China on March 14, 2010, is hereby promulgated and shall come into force as of the date of promulgation.

Decision of the National People's Congress on Amending the Electoral Law of the People's Republic of China on the National People's Congress and Local People's Congresses

It is decided at the third session of the 11th National People's Congress of the People's Republic of China to amend the Electoral Law of the People's Republic of China on the National People's Congress and Local People's Congresses as follows:

I. The first paragraph of Article 6 shall be revised to read: "Deputies for the National People's Congress (NPC) and the local people's congresses shall be broad-based and shall consist of an appropriate number of grass-roots deputies, especially the workers, farmers, and intellectual deputies; the deputies shall comprise of an appropriate number of women, who shall account for an increasingly larger percentage".

II. Article 8 shall be renumbered as Article 7 and revised to read: "the electoral expense of the NPC and the local people's congresses shall be included in the fiscal budget and shall be taken by the National Treasury".

III. A new article shall be added to the law as Article 9, which reads: "members of the Election Committee of the municipalities, municipal jurisdictions, counties, autonomous counties which are not divided into districts shall be appointed by the Standing Committee of the People's Congress of the same level. Members of the Election Committee of a township, ethnic township, and town shall be appointed by the Standing Committee of the People's Congress of the municipality, municipal jurisdiction, county, and autonomous county which are not divided into districts."
"The Election Committee members who are selected as deputy candidates shall resign from the Election Committee."

IV. An new article shall be added to the law as Article 10, which reads: "The Election Committee shall perform the responsibilities as follows:
1. Divide the electoral districts where the deputies of the people's congress are to be elected, and allocate the number of deputies for each electoral district;
2. Conduct the voter registration, examine the voter qualifications and release the voter list; take claims of different opinions on voter list and render decisions;
3. Set the election date;
4. Seek for and verify information on deputy candidates and organizing gatherings for candidates introduction; determining and releasing the final deputy candidate list;
5. Host the election via voting;
6. Determine the validity of the election and release the list of the deputies elected; and
