The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all the ministries and commissions of and institutions directly under the State Council,
For the purpose of enhancing, supervising, administering and improving the quality and safety of dairy products and ensuring the health of general public, following consent of the State Council, relevant issues are hereby set out as follows:
I. Production and operation license shall be put under strict control.
1. Tighten the control of dairy industry. All provinces (autonomous regions and municipalities directly under the Central Government) shall strictly implement relevant policies concerning the dairy industry, carefully examine new and reconstruction (extension) projects, focus on necessary requirements with respect to initial scale, milk resource bases, reasonable distribution and investors, and avoid random investment and repeated construction. Construction of projects which fails to meet relevant requirements shall not be approved. Existing dairy projects shall go through examination, approval and clearance anew prior to the end of 2010, and competent quality supervision departments shall legally cancel the production license of relevant enterprises that fail to satisfy relevant examination and approval requirements.
2. Regulations concerning dairy production licensing shall be tightened. Dairy production licensing regulations shall be further tightened in line with the principle of strict control; contracting, subcontracting and leasing of dairy production enterprises for the purposes of avoiding supervision and administration shall be prohibited; reproduction of milk power shall be prohibited; sub-packaged milk powder shall be strictly restricted in accordance with law. The General Administration of Quality Supervision, Inspection and Quarantine (GAQSIQ) shall amend the detailed rules for the examination and approval of dairy production licensing prior to the end of October 2010. Provincial departments of quality supervision shall strictly examine the applications for production license and enterprises that fail to meet relevant requirements shall not obtain a production license. Enterprises that have obtained a production license shall go through examination and approval anew prior to the end of February 2011 in accordance with the amended requirements for the examination and approval of production licensing. Enterprises which fail to meet relevant requirements shall be ordered to stop dairy product production and marketing and take remedial actions within a specified time limit. The production license of enterprises which fail to take proper remedial actions shall be legally revoked or cancelled and the list of such enterprises shall be made public. Local governments shall revoke the business license, take back the tax invoices and dismantle the equipment and facilities of enterprises whose production license have been cancelled or revoked in order to prevent such enterprises from operating illegally.
3. Administration of raw and fresh milk purchase and transportation shall be strengthened. Competent departments of husbandry and veterinarians shall strengthen the license administration of raw and fresh milk purchasing stations and relevant vehicles, and strictly examine relevant qualifications and conditions. License shall not be given to entities or individuals other than the dairy product enterprises, cow farms, dairy farmers and dairy production cooperatives that have registered with competent department of industry and commerce. Mergers, acquisitions and restructuring shall be encouraged in order to promote the standardized construction of raw and fresh milk purchasing stations. Raw and fresh milk purchasing stations which have been ordered to close down shall be sealed up, and their equipment and facilities shall be dismantled so as to prevent them from purchasing milk illegally. Competent departments of husbandry and veterinarians shall inform competent quality supervision departments at the same level and local cow breeders as well as dairy product enterprises of the information on closedown of such purchasing stations.
4. Administration of dairy product circulation licensing shall be enhanced. Competent departments of industry and commerce shall detail and improve relevant systems for dairy product circulation licensing and further define the requirements for the qualification of entities engaged in dairy product circulation. Dairy products shall be listed as food circulation licensing items, and relevant entities engaged in dairy product circulation shall be examined and approved separately and their business scope shall be registered in accordance with the licensing items.
