The Provisions of Shanghai Municipality on the Administration of Civilized Construction of Engineering Projects, which was adopted at the 57th executive meeting of the Shanghai Municipal People's Government on September 21, 2009, is released hereby and shall take effect as of the date of December 1, 2009.

Provisions of Shanghai Municipality on the Administration of Civilized Construction of Engineering Projects

Article 1 (Purpose and Basis)
With a view to promoting civilized construction of engineering projects in this Municipality and keeping the city clean and tidy, these Provisions are formulated in accordance with the relevant laws and regulations of the State, and in the light of the actual circumstances of this Municipality.
Article 2 (Definition)
"Civilized construction" mentioned in these Provisions refers to construction activities in the course of completing an engineering project and related demolition of buildings that are carried out with the required measures to protect the working conditions of the construction site, to improve the city appearance and environment sanitation, to protect the health of the workers at the site, and to minimize the environmental impact of the construction on the surroundings.
Article 3 (Application Scope)
These Provisions shall govern the construction and demolition activities and other related activities that are carried out within the jurisdiction of this Municipality and the supervision and management thereof.
Article 4 (Administrative Departments)
The municipal administrative department of construction and transportation is the competent administrative department of this Municipality for civilized construction of engineering projects. The municipal regulative agency of construction market shall be responsible for the routine supervision and management relating to civilized construction in this Municipality.
The district/county construction administration department of this Municipality shall be responsible for the supervision and management of civilized construction in their respective jurisdictions within their respective powers and responsibilities.
Other related administrative departments of this Municipality shall cooperate in the implementation of these Provisions within their respective powers and responsibilities.
Article 5 (Requirements Regarding Bidding and Contracting)
In bidding or contracting for a construction or demolition project, the developer shall specify in the bid invitation documents or the contract with the contractor the requirements for and measures to be taken by the designer, contractor and supervisor in connection with civilized construction.
Article 6 (Fees for Measures to Be Taken for Civilized Construction)
In preparing budgetary estimates and the budget of a project, the developer shall specify the fees for measures to be taken for civilized construction in compliance with relevant provisions of the State, and list them separately in the bid invitations or the contract with the contractor.
When completing the construction project's safety and quality inspection procedures, the developer shall at the same time provide an itemized list of fees for measures to be taken for civilized construction, and shall make timely payments of such fees to the contractor in accordance with the contract. The contractor shall use such fees for the specific purpose of civilized construction.
The municipal administrative department of construction and transportation shall, jointly with the municipal administrative department of development and reform, and the municipal administrative department of finance, set the specific rate of fees for measures to be taken for civilized construction.
