The Ministry of Transport ("MOT") and Ministry of Commerce ("MOFCOM") have revised and re-issued the Administrative Provisions on Foreign Investment in the Road Transport Sector (Order of the MOT and MOFTEC [2001] No.9). The new Administrative Provisions on Foreign Investment in the Road Transport Sector (the "Provisions") came into force as of January 11, 2014.
Article 11 of the new provisions is amended to read: "provincial commerce authorities shall make a decision in writing on whether to approve a project within forty-five (45) days following the receipt of application documents. Where the requirements are met, authorities shall issue or approve the changes of the Certificate of Approval for Foreign-invested Enterprises; where the applicant fails to meet the requirements, authorities shall reject the application and notify the applicant in writing and provide reasons." A new article is inserted after Article 19 as Article 20 to read: "provincial transport authorities shall report the approval of foreign investment projects in their own provinces to the MOT before March 31 each year."
