Recently, the Supreme People's Court (SPC) has issued the Regulations on Judicial Accountability in People's Courts (the "Regulations"), which take effect on the date of issuance.
The Regulations further specify, in the field of adjudication, the relevant provisions of the Regulations on CPC Disciplinary Action and the Law of the People's Republic of China on Administrative Discipline for Public Officials concerning violations of work discipline and failure to perform, or improper performance of, duties. The Regulations clearly specify what constitutes a breach of adjudicative duties and how judicial accountability is to be pursued. Comprising six chapters and 47 articles, the Regulations cover the following areas: (1) the basic principles of judicial accountability; (2) the scope of judicial accountability; (3) rules for the application of judicial accountability; (4) procedural requirements for pursuing judicial accountability; and (5) forms of accountability.
