Recently, the National Development and Reform Commission (NDRC) and the Supreme People's Procuratorate (SPP) have jointly issued the Typical Cases on the Implementation of the Private Sector Promotion Law (Second Batch) (the "Typical Cases").
The Typical Cases comprise 10 cases, including the case of Wang X. for occupational embezzlement, misappropriation of funds, and bribery by a non-state functionary; the case of Bai X. for occupational embezzlement; and the case of Liu X. for concealing or disguising the proceeds of crime. These cases highlight four key features: (1) proactive performance of duties, with the Four Pillars of Procuratorial Work providing comprehensive protection for the lawful rights and interests of private enterprises; (2) strengthened legal supervision, with a continued focus on addressing prominent issues in enterprise-related law enforcement and judicial activities; (3) assistance in overcoming operational challenges faced by private enterprises; and (4) equal protection to help foster a fair, transparent, and law-based business environment. The Typical Cases demonstrate the procuratorial authorities' comprehensive performance of their criminal, civil, administrative, and public interest litigation procuratorial functions, the rigorous implementation of the legislative principles of the Private Sector Promotion Law, the equal protection of the lawful rights and interests of all types of business entities in accordance with the law, and continued efforts to foster a law-based business environment.
