The State Administration for Market Regulation (SAMR) has drafted the Ten Rules for Subsidy Practices of Food Delivery Platforms (Draft for Comment) (the "Draft") to solicit public opinions by July 17, 2026.
The Draft mainly covers four aspects. First, it sets forth the general principles, stipulating that food delivery platforms shall not use long-term or substantial subsidies to exclude or restrict market competition or disrupt the market competition order. Second, it introduces specific requirements, under which platforms are prohibited from compelling their online operators to participate in subsidy activities or bear subsidy costs, abusing their capital advantages to engage in monopolistic or unfair competition practices, and from selling goods below cost. Third, it clarifies supervisory measures, requiring the disclosure of relevant information to the public both before and after the subsidy activities, and specifying the main information subject to disclosure to facilitate public supervision. Fourth, it details the legal risks, stressing relevant legal provisions to be observed by food delivery platforms for their subsidy practices and legal consequences for violations.
