The State Administration for Market Regulation (SAMR) recently released the Circular on Launching a Special Campaign to Rectify False Promotion in Online Food Sales (the "Circular").
According to the Circular, the SAMR has decided to carry out a six-month special campaign to rectify false promotion in the online sales of food and health food, starting from April 2026. The Circular clarifies that this campaign will cover online trading platform operators involved in online food sales (including livestream e-commerce platform operators and social e-commerce platform operators), operators within platforms, livestreaming room operators, livestreaming marketing service institutions, livestreaming marketing personnel, as well as advertising entities such as advertisers, advertising operators, advertising publishers, and advertising endorsers, and relevant food production and business operators, among others. The campaign will strictly combat the following acts: (1) false promotion; (2) illegal advertising; and (3) violations committed by platform institutions. The implementation processes and work requirements for the campaign are also specified.
