On April 30, the Supreme People's Court (SPC) issued the Interpretation on Several Issues Concerning the Application of the Time Limit for Administrative Litigation (the "Interpretation"), with effect from May 1, 2026.
The Interpretation, consisting of 11 articles, mainly addresses 10 issues: (1) the coordination between the time limit for filing a lawsuit and other conditions for instituting an action; (2) the commencement of the six-month time limit and the maximum one-year time limit; (3) the conditions for applying the maximum time limit; (4) the specific circumstances for the suspension and extension of the time limit and the burden of proof; (5) the handling of incorrect notification of the time limit; (6) the time limit for filing a lawsuit against reconsideration actions by reconsideration authorities; (7) the commencement of the time limit in cases involving passive omission; (8) the handling of cases involving the "reopening of administrative procedures"; (9) the time limit for filing a lawsuit in cases involving administrative registration with incorrect identity information; and (10) the time limit for filing a lawsuit in cases involving marriage registration with a false identity.
