NHC Seeks Comments on Administrative Provisions on Narcotic Drugs and Psychotropic Substances in Medical Institutions

The National Health Commission (NHC) has drafted the Administrative Provisions on Narcotic Drugs and Psychotropic Substances in Medical Institutions (Draft for Comment) (the "Draft") to solicit public opinions by May 8, 2026.

The Draft mainly involves: (1) expanding the scope from narcotic drugs and Category I psychotropic substances to narcotic drugs and psychotropic substances (including both Category I and Category II); (2) increasing the duties to be assumed by the departments of traditional Chinese medicine, disease control, and military health to improve comprehensive industrial management mechanism; (3) refining requirements on internal management systems of medical institutions as well as those on training and assessment; (4) adding provisions on informed consent; (5) setting forth detailed management provisions on the recovery and destruction of narcotic and psychotropic drugs, and requiring medical institutions to ensure effective implementation through measures such as explicit notification and health education; (6) clarifying provisions on the safety and emergency management of such drugs; and (7) establishing a dedicated chapter on information-based management to strengthen full-process management of narcotic and psychotropic drugs in medical institutions through digital and intelligent technologies.
