GAC Seeks Comments on Amending the Regulations on the Origin of Import and Export Goods

Recently, the General Administration of Customs (GAC) has released the Regulations of the People's Republic of China on the Origin of Import and Export Goods (Draft Amendment for Comment) (the "Draft") for public consultation. The deadline for submitting comments is May 1, 2026.

The Draft involves amendments to Articles 3, 5, 10, and 13. The main revisions are as follows: (1) adding provisions for formulating supplementary rules on determination of origin; (2) adjusting the applicable circumstances under which minor processing or handling is disregarded when determining the origin of goods; and (3) adding provisions to align with relevant articles of the Tariff Law of the People's Republic of China. In particular, the Draft revises the provision "when determining whether goods are wholly obtained in a country or region, the following minor processing or handling shall be disregarded" to "when determining the origin of goods, the following minor processing or handling shall be disregarded."
