SPP Issues Typical Cases on the Mechanism to Connect and Transform Motions from Deputies into Procuratorial Recommendations for Public Interest Litigation

The Supreme People's Procuratorate (SPP) has released the Second Batch of Typical Cases Derived from the Mechanism to Connect and Transform Motions from People's Congress Deputies and Proposals from CPPCC Members into Procuratorial Recommendations for Public Interest Litigation.

The SPP selected and compiled 10 typical cases, including the "administrative public interest litigation case handled by the Beijing Railway Transport Procuratorate to urge rectification of false publicity related to intangible cultural heritage", as representative cases of the mechanism for linking and transforming motions from deputies and proposals from members of the Chinese People's Political Consultative Conference (CPPCC) into procuratorial recommendations for public interest litigation. In terms of the sources of case leads, six cases originated from motions of deputies to people's congresses and four from proposals of CPPCC members; in terms of case types, eight were administrative public interest litigation cases in the "pre-litigation" procedure and two were administrative public interest litigation cases in which lawsuits were filed; in terms of the areas involved, the cases cover areas such as protection of intangible cultural heritage, quality and safety of agricultural products, protection of sites evidencing Japanese aggression against China, and food safety. The procuratorial authorities comprehensively adopted measures, such as issuing procuratorial recommendations for administrative public interest litigation, initiating administrative public interest litigation, organizing public hearings, and empowering supervision through data, used the handling of individual cases as an entry point to conduct supervision for similar cases, thereby promoting industry governance, and providing important references for the revision and improvement of local regulations.
