MPS Seeks Comments on the Law on the Prevention and Control of Cybercrime

Recently, the Ministry of Public Security (MPS) has released the Law on the Prevention and Control of Cybercrime (Draft for Comment) (the "Draft") for public consultation. The deadline for submitting comments is March 2, 2026.

The Draft consists of seven chapters and 68 articles and mainly provides for the following: (1) clarifying the management system for basic internet resources, including prohibiting any individual or organization from interfering with or undermining real-name registration systems and strengthening the monitoring and control of abnormal online activities; (2) establishing a governance framework for the cybercrime ecosystem, by imposing legal regulation on "black and gray" industry chains that play a foundational role in cybercrime, such as online payment and traffic diversion and promotion services; (3) specifying obligations for the prevention and control of cybercrime, by setting differentiated duties for online service providers based on factors such as business scale and technical capabilities, and by establishing and applying the national public services for online identity authentication; and (4) clarifying mechanisms for the prevention and control of cross-border cybercrime, including sanctions against cross-border cybercrime, regulation of cross-border online services, and restrictions on the entry into and exit from the country of the relevant persons.
