Recently, the Ministry of Industry and Information Technology (MIIT) has drafted and released the Administrative Measures for Industrial Water Conservation (Draft for Comment) (the "Draft") for public consultation. Comments may be submitted during the public consultation period, which will close on February 28, 2026.
The Draft provides that industrial enterprises shall fulfill their water conservation obligations, strictly comply with laws, administrative regulations, rules, and standards on water conservation, implement management systems for water use metering and water use and conservation statistics, carry out water-saving technological upgrades, prioritize the adoption of advanced water-saving processes, technologies, and equipment, to improve the efficiency of water resource utilization. According to the Draft, industrial enterprises whose water use reaches a certain scale shall strictly implement the planned water use management system. The specific scale shall be determined in accordance with the administrative measures for planned water use formulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government; where no separate measures are issued, the Administrative Measures for Planned Water Use of the Ministry of Water Resources shall apply. In addition, industrial enterprises' water use plans shall be formulated based on water use quotas and the annual water use plan of the relevant administrative region. For industrial enterprises subject to water intake permit administration, the water source type and purpose of water use specified in their water use plans shall be aligned with those set out in their water intake permits.
