Recently, the People's Bank of China (PBC) has issued the Measures of the People's Bank of China for Administrative Reconsideration (the "Measures"), which will take effect on March 1, 2026.
According to the Measures, citizens, legal persons, or other organizations may apply for administrative reconsideration with the PBC or its branches within the scope of administrative reconsideration as prescribed by the Law of the People's Republic of China on Administrative Reconsideration (Revised in 2023) and its implementation regulations. The Measures clarify that, after accepting an application for administrative reconsideration, an administrative reconsideration authority shall conduct the review by applying either the ordinary procedure or the summary procedure in accordance with the law. If the administrative reconsideration authority considers that the facts of a case are clear, the rights and obligations are well defined, the dispute is minor, or all parties concerned consent, the summary procedure may be applied in accordance with the law. Administrative reconsideration officers shall maintain the confidentiality of any state secrets, trade secrets, and personal privacy they come to know in the course of handling administrative reconsideration cases. In addition, the Measures provide that where staff members of the PBC or its branches engage in favoritism, malpractice, or other dereliction or negligence of duty in administrative reconsideration activities, they shall be subject to disciplinary sanctions in accordance with the law; if a crime is suspected, the matter shall be transferred to judicial authorities for criminal liability to be pursued in accordance with the law.
