SAMR Seeks Comments on the Provisions on the Assistance of E-commerce Platforms in Investigating and Handling Trademark Infringement Cases

The State Administration for Market Regulation (SAMR) recently released the Provisions on the Assistance of E-commerce Platforms in Investigating and Handling Trademark Infringement Cases (Draft for Comment) (the "Draft") for public consultation by December 14, 2025.

The Draft mainly involves the following rules: (1) where existing evidence can preliminarily prove the existence of a trademark infringement act, the market regulation authority may notify the e-commerce platform operator to take intellectual property protection measures as required by law; (2) where the address information of an online store operator involved in the case is inaccurate and no contact can be established, the market regulation authority shall inform the e-commerce platform operator, who shall then provide prominent marking on the relevant store and product information at the top of the page and notify the online store operator to provide accurate information and cooperate with the investigation; (3) for an offense involving multiple regions, the jurisdictional division and cooperation requirements among local market regulation authorities are clarified; and (4) where an e-commerce platform operator facilitates an act of or assists others in infringing upon the exclusive right to use a trademark, thereby violating these provisions, the market regulation authority shall carry out investigation and handling measures in accordance with the law.
