MCA Issues the Guidelines for the Record-filing of Public Fundraising Plans by Charitable Organizations

Recently, the Ministry of Civil Affairs (MCA) has issued the Guidelines for the Record-filing of Public Fundraising Plans by Charitable Organizations (for Trial Implementation) (the "Guidelines"), which will take effect on January 1, 2026.

According to the Guidelines, charitable organizations with public fundraising qualifications, as well as other nonprofit organizations permitted by laws and administrative regulations to conduct public fundraising, shall, before publicly raising funds from the public for charitable purposes, complete the record-filing of their public fundraising plans in accordance with the requirements of the Guidelines. The competent authorities responsible for accepting record-filing applications are the civil affairs authorities under the people's governments at or above the county level. The Guidelines specify three categories of filing materials: (1) the public fundraising plan record-filing form and related attachments; (2) materials for cooperative fundraising; and (3) other relevant materials. The Guidelines also state that no fees shall be charged for the record-filing and set out six specific requirements, including requirements for internal decision-making, external approval, and separate record-filing.
