Recently, the State Administration for Market Regulation (SAMR) and the Ministry of Commerce (MOFCOM) have drafted the Announcement on Further Strengthening the Regulation of Recalls of Imported Food in Cross-border E-commerce Retail (Draft for Comment) (the "Draft") and is now soliciting public comments. The deadline for submitting comments is October 8, 2025.
The Draft includes three key points: First, it further emphasizes the responsibility of cross-border e-commerce enterprises, requiring them to bear primary responsibility for food safety in cross-border e-commerce retail imports and to establish recall mechanisms for such imported food. Second, it clarifies the domestic recall entity, requiring cross-border e-commerce enterprises to entrust a domestic enterprise, through signing agreements such as entrustment contracts, to assist in carrying out recalls of cross-border e-commerce retail imported food. This provides market regulatory authorities with a clear domestic entity for recall regulation. Third, it strengthens the responsibility of cross-border e-commerce platforms, requiring such platforms to assist with recall efforts. In the event of any quality or safety issues with cross-border e-commerce retail imported food, platforms should urge cross-border e-commerce enterprises and their entrusted domestic entities to conduct recalls. Cross-border e-commerce enterprises that fail to take proactive recall measures will have their cross-border e-commerce business suspended.
