Eight Authorities Solicit Comments on the Administrative Measures for Special Anti-Money Laundering Preventive Measures

Recently, the People's Bank of China (PBC) and seven other authorities have jointly released the Administrative Measures for Special Anti-Money Laundering Preventive Measures (Draft for Comment) (the "Draft") and are now soliciting public comments. The deadline for submitting comments is October 5, 2025.

The Draft covers general provisions, lists and enforcement, obligations regarding special anti-money laundering (AML) preventive measures, legal liability, and supplementary provisions. In particular, with respect to obligations on special AML preventive measures, the Draft provides that financial institutions should establish systems and strengthen risk management related to special AML preventive measures, promptly obtain the lists, and conduct checks on customers and their counterparties. Upon verification, financial institutions must immediately adopt special AML preventive measures and report to the relevant authorities. The Draft also clarifies that financial institutions may request assistance from the issuing authority in verifying whether customers or their counterparties are included on the lists. In addition, the Draft specifies the circumstances under which special AML preventive measures should be immediately lifted, the procedures for handling objections to such measures raised by financial institutions, the handling of receivables during the period when measures are in place, and the requirements for specified non-financial institutions to implement the measures by reference.
