The Ministry of Transport (MOT) has recently issued the Administrative Provisions on International Road Transport (Draft Revision) (the "Draft") for public consultation, with feedback due by September 18, 2025.
The Draft consists of nine chapters and 55 articles, covering general provisions, passenger transport management, freight transport management, common provisions, transport permit management, inspection of road transport vehicles for entry and exit at border ports, supervision and inspection, legal liability, and supplementary provisions. With respect to passenger transport management, the Draft makes the following key revisions: First, it specifies that operators engaging in international road passenger transport must be corporate entities holding a domestic passenger transport business license for Class II or above passenger routes or for interprovincial chartered bus services. Second, it adjusts the procedures for applying for regular passenger transport routes, clarifying that a separate application is required for international road passenger transport routes in addition to the enterprise's existing license, and elaborates on bilateral and multilateral consultation procedures. It also clarifies that when non-border provinces organize the launch of regular passenger transport routes, they are not required to consult with the border port provinces along the route. Third, it stipulates that the scope of irregular international passenger transport routes must be limited to the districted-city level administrative area where the vehicle is registered, so as to prevent disorderly competition in the market.
