Two Departments to Enhance Regulation in Recall and Production Consistency of Intelligent Connected New Energy Vehicles

The State Administration for Market Regulation (SAMR) and the Ministry of Industry and Information Technology (MIIT) have jointly drafted the Circular on Strengthening the Product Recall, Production Consistency Regulation, and Standardized Publicity of Intelligent Connected New Energy Vehicles (Draft for Comment) (the "Draft") for public consultation by September 15, 2025.

The Draft introduces multiple requirements in four areas, including strengthening the defect investigation and recall management of intelligent connected new energy vehicles, and enhancing the supervision and administration of production consistency for such vehicles. Notably, the Draft specifies that when enterprises provide consumers with information on the driving automation levels, system capabilities, system boundaries, and other aspects of intelligent connected new energy vehicles, such information shall be truthful and comprehensive, and shall not include any false statements, exaggerations of system capabilities, or misleading publicity, thereby ensuring that consumers have an accurate understanding of the intelligent connected new energy vehicles and can operate them correctly. In naming and marketing combined driving assistance systems or functions, enterprises shall not suggest that consumers may regard them as autonomous driving systems or as having functions that they do not in fact possess, so as to prevent misuse by drivers.
