Recently, the Ministry of Justice (MOJ) and two other authorities have jointly issued the Guiding Opinions on Further Strengthening the Supervisory Role of Administrative Reconsideration to Regulate Enterprise-related Administrative Enforcement (the "Opinions") along with typical cases.
The Opinions put forward 22 specific measures across seven key areas: overall requirements; clarifying the focus of administrative reconsideration supervision on enterprise-related enforcement; enhancing administrative reconsideration's capacity to address enterprise-related administrative disputes; deepening substantive resolution of such disputes; improving the standardization and effectiveness of handling enterprise-related administrative reconsideration cases; strengthening administrative reconsideration to promote governance through cases; and consolidating efforts to standardize enterprise-related enforcement. To strengthen administrative reconsideration supervision and regulate enterprise-related administrative enforcement, the Opinions identify five major priorities: intensifying governance on prominent issues of enterprise-related fines; enhancing supervision of government credibility in enterprise-related matters; handling cases in enterprise management fields according to law; reinforcing review of normative documents related to enterprises; and urging the fulfillment of legal documents for enterprise-related administrative reconsideration.
