The National Development and Reform Commission (NDRC) and the State Administration for Market Regulation (SAMR) recently issued the Pricing Law of the People's Republic of China (Draft Amendment for Comment) (the "Draft") to solicit public opinions by August 23, 2025.
The Draft primarily involves: (1) improving relevant provisions on government pricing; (2) further defining the criteria for identifying unfair pricing practices; and (3) enhancing the legal liability system for price violations. Regarding the criteria for identifying unfair pricing practices, the Draft proposes the provisions in the following aspects: (1) improving the criteria for identifying low-price dumping, regulating the market pricing order, and curbing involution-style competition; (2) refining the criteria for identifying unfair pricing practices such as price collusion, price gouging, and price discrimination; (3) prohibiting public utilities, industry associations, and other similar entities from leveraging their influence or dominant industry position to compel or bundle the sale of goods or provision of services and collect relevant charges; and (4) tightening the regulation of the pricing behaviors by operators of business premises.
