State Council Publishes Regulations on Housing Rental

The State Council has released the Regulations on Housing Rental (the "Regulations"), effective from September 15, 2025.

The Regulations aim to regulate housing rental activities, safeguard the legitimate rights and interests of the parties in housing rental activities, maintain stable housing rental relationships, boost the high-quality development of housing rental market, and facilitate the establishment of a housing system that supports both housing rentals and purchases. The Regulations, consisting of 50 articles in seven chapters, mainly involve (1) clarifying overall requirements; (2) regulating leasing and renting activities; (3) regulating the behaviors of housing rental enterprises; (4) regulating the behaviors of brokerage agencies; (5) enhancing supervision and administration; and (6) ensuring strict accountability. Notably, the Regulations require housing rental enterprises to publish true, accurate, and complete housing information, establish housing rental archives and improve internal management systems. Those engaging in subleasing business shall set up a supervised housing rental fund account as required. Housing brokerage agencies are also required to verify and record the information on the entrusting parties as well as the ownership information, conduct on-site inspections of the properties before listing, prepare a housing condition report, and clearly mark the prices of their services.
