CNIPA Issues Measures for Fast Track Examination of Trademark Registration Applications

The China National Intellectual Property Administration (CNIPA) has recently released the Measures for Fast Track Examination of Trademark Registration Applications (the "Measures"), with effect on the date of issuance.

The Measures specify that trademark registration applications falling under one of five circumstances—such as those related to strategic emerging industries vital to national development, including commercial aerospace, low-altitude economy, deep-sea technology, as well as future industries like biomanufacturing, quantum technology, embodied intelligence, and 6G, and for which exclusive trademark rights are urgently needed — may apply for fast track examination. Trademark applications requesting fast track examination must meet six conditions, including obtaining the "unanimous consent of all applicants." Upon receiving a fast track request, the CNIPA will conduct a thorough review of the application materials. Applications that meet the criteria set forth in the Measures will be granted fast track examination, which should be completed within 20 working days. If an application does not meet the criteria, the CNIPA will deny the fast track examination request and notify the applicant within five working days. Denied applications will proceed through the regular examination procedures as prescribed by law.
