Recently, the National Development and Reform Commission (NDRC) has released the Administrative Measures for Tendering Agencies for Construction Projects (Draft for Public Comment) (the "Draft") and is now soliciting public comments. The deadline for feedback is August 15, 2025.
The Draft establishes a working mechanism under which the NDRC provides guidance and coordination, the Ministry of Housing and Urban-Rural Development (MOHURD) leads the registration process, and competent industry authorities supervise specific agency activities. It also improves management mechanisms including unified registration, project leader accountability, information sharing, and centralized disclosure. The Draft sets out the conduct requirements and corresponding legal liability of tendering agencies in relation to business undertaking, fee collection, organization of bid evaluations, and archive management. Regarding registration management, the Draft specifies the platforms, content, process, and requirements for the registration activities carried out by tendering agencies and their personnel, and includes dedicated provisions on information sharing. The professional management section outlines the basic conditions for tendering agencies to undertake business, personnel management, agency contracts, agency fees, codes of conduct, complaint handling, and document retention.
