SPC and SPP to Improve Legal Supervision Mechanism for Maritime Courts

The Supreme People's Court (SPC) and the Supreme People's Procuratorate (SPP) jointly issued the Circular on Improving the Legal Supervision Mechanism for Maritime Courts (the "Circular").

The Circular specifies that, in order to improve the legal supervision mechanism for maritime courts, the people's procuratorates of 11 cities with subordinate districts are designated to perform legal supervision duties regarding civil litigation, administrative litigation, and enforcement activities of maritime courts. These procuratorates are required to make procuratorial recommendations to maritime courts in relevant cases or request higher-level procuratorates to file protests, thereby carrying out legal supervision. The Circular also sets forth the requirements on communication and coordination mechanisms between maritime adjudication and procuratorial work. Notably, the Circular stipulates that the Shanghai Maritime Court shall be subject to legal supervision by the Third Branch of the Shanghai Municipal People's Procuratorate while the Guangzhou Maritime Court shall be subject to supervision by the Guangzhou Railway Transportation Branch of the Guangdong Provincial People's Procuratorate. The Circular further calls on relevant provincial-level people's procuratorates to strengthen professional guidance for maritime procuratorial work, improve the building of specialized case handling organizations, recruit, train, and deploy professionals, and take the lead in building and improving cross-regional procuratorial cooperation mechanism.
