Recently, the Ministry of Transport (MOT) has issued the Regulations of the People's Republic of China on Road Transport (Draft Revision) (the "Draft") along with five supporting departmental rules, including the Administrative Provisions on Road Transport Practitioners (Draft Revision). The public is invited to provide feedback on the draft revisions until June 7, 2025.
The Draft proposes two amendments, primarily aimed at adjusting the age requirements for drivers engaged in passenger and freight transport operations. Specifically, the current age cap of "no more than 60 years old" would be revised to "meeting the age requirements prescribed by the competent authority of transport under the State Council." Correspondingly, the maximum age for road transport practitioners set in the five supporting departmental rules would be raised from 60 to 63 years old, aligning with the postponed statutory retirement age for male employees. Given the physically demanding nature of the road transport work for practitioners and the increased risks of health issues and fatigue-related driving incidents with increasing age, the proposal does not extend the limit to 66 years at this stage.
