The Ministry of Industry and Information Technology ("MIIT") has recently enacted and issued the Standard Conditions for the Waste Tire Comprehensive Utilization Industry (Revised Draft for Comment) (the "Draft for Comment") and the Interim Measures for Announcement Administration of Standard Conditions for the Waste Tire Comprehensive Utilization Industry (Revised Draft for Comment) to seek public comments by December 24, 2019.
The Draft for Comment mainly touches upon eight aspects, including resource utilization and energy consumption, environmental protection, work safety, and occupational health. Among others, the Draft for Comment expressly states that enterprises shall strictly implement the Environmental Protection Law and submit environmental impact assessment documents to the administrative authorities of ecology and environment for approval; they are also required to strictly practice the "three simultaneous work" mechanism for environmental protection, and effectively implement various measures aimed at ecological and environmental protection. Moreover, the Draft for Comment provides that safety facilities and facilities for prevention and control of occupational hazards, affiliated to projects intended for comprehensive utilization of waste tires, must be designed, constructed and put into production and use simultaneously with the main work; the design of enterprises' safety facilities should be examined according to law, and the completed facilities should legally undergo acceptance inspections before being put into operation and use.
