The Ministry of Ecology and Environment ("MEE") has recently issued the Implementing Opinions on Promoting the Administrative Law Enforcement Publicity System, the Law Enforcement Whole-process Recording System, the Legal Review System for Major Law Enforcement Decisions among Departments of Ecology and Environment (the "Opinions").
The Opinions expressly state that efforts will be made to promote the administrative law enforcement publicity system, the law enforcement whole-process recording system, the legal review system for major law enforcement decisions, in all aspects. The Opinions read that all levels of departments of ecology and environment shall, in line with requirements set out in the Regulations on Government Information Disclosure and the Measures for Environmental Information Disclosure (for Trial Implementation), voluntarily make public information on administrative law enforcement in relation to ecology and environment, prepare and release the list of powers and responsibilities, and establish and improve mechanisms for dynamic adjustments to and long-term management of such list of powers and responsibilities. In addition, the Opinions require that law enforcement documents will serve as the basic form of records to take down particulars throughout the law enforcement process and throughout the internal examination and approval process, for such law enforcement activities as administrative inspections, administrative penalties, administrative enforcement, and administrative approval. Regions where conditions permit are encouraged to use cameras to record the whole enforcement process on the spot.
