Technical Guide to Environmental Impact Assessment Follow-up for Plans (for Trial Implementation)

The General Office of the Ministry of Ecology and Environment ("MEE") has recently issued the Technical Guide to Environmental Impact Assessment Follow-up for Plans (for Trial Implementation) (the "Guide").

The Guide includes "general provisions", "execution of plans and comparisons of development intensity", "evolving trends in regional ecological environment", "public opinion survey", "comparative assessment of eco-environmental impact and analysis of the efficiency of countermeasures", "advice on the improvement of ecology and environment management", etc. Among others, the Guide clearly states that actual impacts caused by the execution of a plan on ecology and environment shall be analyzed through investigations into the implementation of this plan and the evolving trend in the ecological environment in the affected regions, and then be compared and assessed with projected impacts set out in the environmental impact assessment documents. Furthermore, the Guide requires that with regard to the implemented part of a plan, it is possible to suggest proceeding with the implementation of the original plan, provided that countermeasures and measures adopted during the implementation of this plan to prevent or mitigate adverse impacts on ecology and environment are effective and consistent with the latest requirements of the State and the local government for ecology and environment management.
