The General Office of the Ministry of Ecology and Environment ("MEE") has recently issued the Technical Specification for Application and Issuance of Pollutant Discharge Permits: Waste Resources Processing Industry (Draft for Comment) (the "Draft for Comment") to solicit comments from the entities concerned by April 4, 2019.
The Draft for Comment provides for requirements on filling in and reporting the basic information about pollutant discharge entities in the waste resources processing industry in respect of the application and issuance of pollutant discharge permits, methods to determine the permitted emission limits, methods to calculate the amount of pollutants discharged in effect, methods to judge compliance, and other requirements for different aspects of environmental management, ranging from self-monitoring, environmental management standing books to the implementation reports on pollutant discharge permits; it also sets out the requirements on feasible technologies used to prevent and clean up pollution created in the waste resources processing industry. Among others, the Draft for Comment expressly states that, pollutant discharge entities in the waste resources processing industry shall, as per requirements set out in this standard, fill out and submit the relevant information sheets affiliated to the Application Form for a Pollutant Discharge Permit, through the application system available on the national pollutant discharge permit management information platform. Pollutant discharge entities shall provide the basic information based on their actual situations and bear legal liability for the truthfulness, legality and completeness of application documents they submit.
