The Ministry of Transport ("MOT") has recently distributed the Decision on Revising the Provisions on Operating Licensing for Domestic Air Routes of Civil Aviation of China (Draft for Comment) (the "Draft for Comment") for public consultation by April 15, 2019.
According to the Draft for Comment, Article 36 of the Provisions on Operating Licensing for Domestic Air Routes of Civil Aviation of China, previously reading: "the operating license for air routes obtained by an air transport enterprise under these Provisions shall be valid for three years. If no special circumstances arise after its expiry date and this air transport enterprise does not file an application for any changes, such operating license will be automatically renewed for another three years from its expiry date, and the Civil Aviation Administration of China ("CAAC") or the local civil aviation authority may handle the approval or registration under simplified procedures for such licensing", is revised to read now: "the operating license for air routes obtained by an air transport enterprise under these Provisions, if not revoked or deregistered, shall be valid on a long-term basis".
