CAAC to Strengthen Safeguards for General Aviation at Transport Airports

The Transport Department of the Civil Aviation Administration of China ("CAAC") has recently drafted and issued the Circular on Strengthening Safeguards for General Aviation at Transport Airports (Draft for Comment) (the "Draft for Comment") to seek opinions within the industry by March 22, 2019.

The Draft for Comment sets out arrangements in seven aspects, including "lifting the level of ground services to better safeguard general aviation" and "strictly implementing the fee-charging policies for general aviation airports". According to the Draft for Comment, all relevant airports shall give full play to their functions as the public infrastructure with a view to ensuring reasonable and all-round ground services for general aviation flights, adding that airports where flight schedules may be coordinated shall do their best to provide supporting services for general aviation flights, while other airports shall, in line with requirements set forth in the Guiding Opinions of the Civil Aviation Administration of China on the Category-based Administration of General Aviation, shall allow general aviation aircrafts to stand densely on the tarmac and shall not refuse the take-off or landing of general aviation aircrafts with the excuse of weather, unavailability of gate positions, and traffic control. Furthermore, the Draft for Comment expressly states that each airport shall work out a reasonable fee standard for the general aviation airport which shall not be higher than the standard for transport aviation.
