The General Office of the Ministry of Transport ("MOT") has recently enacted and issued the Standards for Services of the Tally Industry (Draft for Comment) (the "Draft for Comment") to seek opinions from the entities concerned by March 8, 2019.
The Draft for Comment contains provisions on "scope", "reference normative documents", "terms and definitions", "service principles", "self-discipline of conduct", etc. Among others, the Draft for Comment states that a business operator doing tally business at ports shall ensure the counting results obtained on the spot are accurate, and the principal will confirm the counting result with its signature on a one-time basis, and the business operator is banned from changing at will the results set out on the tally documents. Also, the Draft for Comment notes that business operators offering tally services at ports shall receive, sort out and review relevant documents, materials or electronic information, including original manifests, lists of released loaded exports, stowage plan of imports and pre-stowage bay plan of exports, as provided by such entities as shipping agents and port operators, and use the same as the basis of tally; in case of any problems, they shall promptly get in contact with the entities concerned to resolve the problems.
