The Flight Standards Department of the Civil Aviation Administration of China ("CAAC") has recently released the Opinions on the Participation of Foreign Civil Aircraft Pilots in the Operation of China's Flights (Revised Version) (the "Revised Version") for public consultation by March 22, 2019.
The Revised Version covers the applicable scope, general requirements, the application for and the issue of aircraft pilot licenses, the application for and the issue of letters of recognition of pilot licenses, etc. Among others, the Revised Version provides that, to fly an aircraft registered overseas, a foreign pilot must hold a pilot license or a letter of recognition issued under the China Civil Aviation Regulation Part 61 (CCAR-61), or hold a valid pilot license issued or recognized by the country where the aircraft is registered, and is required to carry with himself or herself such license or letter of recognition and the valid health check certification justifying his or her good health conditions while exercising the corresponding rights. Meanwhile, the Revised Version states that the organization intending to employ foreign pilots shall, pursuant to requirements of the CAAC in respect of background investigations for civil aviation, launch investigations to check the background of individuals it is going to employ, and submit documents formed through background investigations for review as required.
