Two Departments Arrange Procuratorial Organ's Work on National Judicial Aid to Support the Poverty Relief Battle

Recently, the Supreme People's Procuratorate ("SPP") and the State Council Leading Group Office of Poverty Alleviation and Development have jointly distributed the Implementing Opinions on the Offer of National Judicial Aid by Procuratorial Organs to Support the Poverty Alleviation Battle (the "Opinions"), immediately effective from the date of issuance.

The 21 articles set out in the Opinions are mainly aimed at clarifying the assignment of relevant duties, work principles, referral and handling of clues about poverty, referral and handling of aid clues, safeguards for and use of aid funds, diversified forms of assistance, the joint meeting mechanism, etc. Among others, the Opinions require that where people's procuratorates learn that the parties concerned are stuck in poverty while they are handling cases, they shall immediately activate work procedures for offering the national judicial aid and designate relevant procurators to prioritize such cases, and submit to the poverty alleviation authority relevant written documents, including descriptions of relevant cases, particulars of aid offered and recommendations for poverty alleviation measures, within five working days after the cases have been closed. Furthermore, the Opinions explicitly state that, where poverty alleviation authorities find the parties concerned are suffering from poverty during their work for the poverty alleviation battle, they shall refer their findings as clues about national judicial aid cases to people's procuratorates within five working days.
