The National Energy Administration ("NEA") has recently issued the Administrative Measures for Oil and Gas Plans (Revised in 2019) (the "Measures"), immediately effective from the date of issuance.
Encompassing 40 articles in eight chapters, the Measures provide for "organization and research", "drafting and alignment", "review, approval and release", "implementation and supervision", "assessment and adjustment", etc. The Measures provide that, the oil and gas plans are prepared and designed to fully fulfill goals and tasks and major engineering projects in the oil and gas field outlined in the national development plan and in the energy development plan, and the plans shall make an in-depth analysis of current situations and the future trend of the oil and gas industry, as well as other restrictive and incentive factors, and propose guiding thoughts, basic principles and development goals in respect of the oil and gas development. Furthermore, the Measures require that, the nationwide oil and gas plan shall, in principle, be completed by the end of May of the first year of the five-year period and be submitted to plan approval authorities for deliberation and approval; and a third-party advisory agency shall be entrusted to evaluate the proposed plan and give their opinions, before it is submitted for deliberation and approval.
