MARA Vows to Fully Promote the Legality Review Mechanism for Administrative Normative Documents

The Ministry of Agriculture and Rural Affairs ("MARA") has recently issued the Implementing Opinions on Fully Promoting the Legality Review Mechanism for Administrative Normative Documents (the "Opinions").

The Opinions set out provisions on "general requirements", "clearly specifying the coverage of reviews", "standardizing review procedures", "grasping key aspects of reviews", among others. The Opinions state that documents that are prepared within the statutory authority and under legal processes and publicly released in the MARA's name, shall be all subject to the legality reviews, if they have a bearing on rights and obligations of citizens, legal persons and other organizations and are universally binding and repeatedly referred to within a certain period of time. Also, the Opinions expressly state that, normative documents drafted by offices, bureaus and dispatching offices under departments of the MARA shall be reviewed by the MARA's Department of Regulations to look at their legality before being submitted for deliberation. Where the Department of Regulations identifies any failure to meet relevant requirements while reviewing whether relevant materials are complete and normative, it may require, either orally or in writing, the drafting units to provide additional materials or make an explanation within the designated time limit; where they fail to provide relevant materials or make an explanation, as required, the materials concerned will be returned.
