Two Departments Issue Measures for the Real-name Management of Construction Workers

Recently, the Ministry of Housing and Urban-rural Development ("MOHURD") and the Ministry of Human Resources and Social Security ("MOHRSS") have jointly issued the Measures for the Real-name Management of Construction Workers (for Trial Implementation) (the "Measures"), with effect from March 1, 2019.

The Measures provide that a construction project owner shall reach an agreement with the construction enterprise on relevant matters concerning the real-name management of construction workers, urge it to practically take various measures for the real-name management of construction workers, and transfer, in line with the project progress, the remuneration of construction workers on time and in full amount to the bank account opened by the construction enterprise exclusively for workers' remuneration. Meanwhile, the Measures expressly state that, a construction enterprise shall shoulder the responsibility for the real-time management of laborers working on the construction site; and the general contractor shall bear the overall responsibility for the real-name management of all construction workers engaged in the project it undertakes, while the sub-contractor will be held directly responsible for the real-name management of construction workers it employs. According to the Measures, real-name information of construction workers includes their basic information, information on their previous employment, and credit-related information. Necessary expenditures for the real-name management of construction workers may be counted into the safe and civilized construction costs or into the management costs.
