SAMR Pledges an Integrated Administrative Law Enforcement System to Better Serve Law Enforcement

The General Office of the State Administration for Market Regulation ("SAMR") has recently enacted and issued the Opinions on Integrating Resources to Create the 12315 Administrative Law Enforcement System to Better Serve Market Regulation and Law Enforcement (the "Opinions").

According to the Opinions, it is expected to basically establish a unified, authoritative and highly-efficient 12315 administrative law enforcement system, by the end of 2020. To this end, the Opinions outline eight tasks which include "unifying service hotlines and rolling out a sole hotline among the general public", "integrating operating platforms and improving function modules", "unifying the work agencies and forming the interconnection in a five-level hierarchy" and "unifying rules and specifications and optimizing work procedures". Among others, the Opinions note that previous rules concerning complaints and reports formulated by departments of industry and commerce, quality inspection, food and drug, price, and intellectual property will be consolidated to form the unified Measures for the Handling of Complaints and Reports by Market Regulators and templates of relevant documents; also, the Work Rules for 12315 Complaints and Reports Centers will be worked out to clearly specify the connotations of complaints and reports, duties of administrative agencies, the scope of complaints and reports to be accepted, principles on jurisdiction, processing procedures, and the time limit provided for handling a complaint or report.
