The Certification and Accreditation Administration of China ("CNCA") has recently enacted and issued the Implementation Guide to Revised Articles Concerning Testing and Certification in the Agreement on Trade in Services under the Mainland and Hong Kong Closer Economic Partnership Arrangement and the Implementation Guide to Revised Articles Concerning Testing and Certification in the Agreement on Trade in Services under the Mainland and Macao Closer Economic Partnership Arrangement (collectively as the "Guides").
The Guides provide for the implementation coverage, qualifications of testing agencies and regulatory requirements, implementing procedures, and responsibilities of domestic market regulators for regulating activities carried out under the guides, and other relevant matters. The Guides state that the implementation will cover all products listed on the China Compulsory Certification (CCC) catalog and products that are processed or manufactured on the Chinese mainland. To engage in testing business for CCC products, a testing agency located in Hong Kong or Macao needs to be licensed by the local accreditation department of the government of the Hong Kong Special Administrative Region ("HKSAR") or of the Macao Special Administrative Region ("MSAR") and shall have the capacity to test CCC products. According to the Guides, Hong Kong or Macao testing agencies may get in touch with the designated CCC product certification agencies on the Mainland and declare their intention to seek cooperation, if they hold the required qualifications and intend to undertake the testing business for CCC products.
